These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Ampersant ("we," "us," or "our") governing your access to and use of the Mood Bubs mobile application (the "App"), including any content, features, and services offered through it.
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not download or use the App.
If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are a parent or guardian permitting a minor to use the App, you accept responsibility for the minor's use of the App and compliance with these Terms.
Subject to your compliance with these Terms, Ampersant grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a compatible mobile device that you own or control, solely for your personal, non-commercial entertainment purposes.

This license is effective until terminated by you or by us. Your rights under this license will terminate automatically if you fail to comply with any provision of these Terms.
The App may offer optional in-app purchases, including but not limited to hint packs, cosmetic content, or other premium features (collectively, "Purchases"). All Purchases are processed through Apple's App Store or Google Play, depending on your platform. By making a Purchase, you agree to the payment terms of the applicable platform.
Non-Refundable Policy: All Purchases are generally final and non-refundable, except where required by applicable law. Consumable items (such as hints) are used up upon consumption and cannot be restored, refunded, or transferred after use.
Platform Refund Policies: Refund requests must be submitted directly to Apple (via Apple's Report a Problem service) or Google (via Google Play's refund system) according to their respective policies. Ampersant does not process refunds directly.
Pricing: Prices for in-app purchases are displayed in the App at the time of purchase and may vary by region. Ampersant reserves the right to change pricing at any time.
Purchase Restoration: Non-consumable purchases may be restored on compatible devices associated with the same Apple ID or Google account used for the original purchase. Consumable purchases cannot be restored.
The App may include virtual currency — such as coins — and virtual items such as hints, skins, and other cosmetic or functional content (together, "Virtual Items"). Virtual Items may be earned through gameplay, granted promotionally, or purchased with real money.
No Monetary Value: Virtual Items have no monetary value and do not constitute currency, legal tender, credit, or property of any kind. They cannot be redeemed for cash, exchanged for anything of real-world value, or converted into any other form of consideration, whether from Ampersant or any third party.
License, Not Ownership: You do not own Virtual Items. When you obtain a Virtual Item, Ampersant grants you a limited, personal, non-transferable, non-sublicensable, revocable license to use it within the App only. All Virtual Items remain the property of Ampersant.
Non-Transferable: Virtual Items may not be sold, gifted, traded, transferred, sublicensed, or otherwise disposed of outside the App, and may not be transferred between accounts or devices except through the purchase restoration mechanisms provided by the applicable app store. Any attempt to do so is void and may result in termination of your license under Section 10.
Pricing and Availability May Change: Ampersant may, at its sole discretion and without prior notice or liability, change the price, earning rate, availability, function, or in-game effect of any Virtual Item; introduce or discontinue Virtual Items; or modify how Virtual Items are obtained or spent. Changes may apply to Virtual Items you already hold. Where changes are material and we are able to do so, we will provide notice within the App.
Forfeiture: Unused Virtual Items are forfeited without refund or compensation if your license is terminated under Section 10, if you uninstall the App and no restorable record exists, or if the App or the relevant feature is discontinued. Ampersant is under no obligation to compensate you for any unused Virtual Items under any circumstances.
No Refunds: Virtual Items obtained through in-app purchase are consumable digital content and are non-refundable once delivered, except where a refund is required by applicable law or granted by the platform operator under Section 3.
Nothing in this Section limits any rights you have under mandatory consumer protection law in your jurisdiction.
You agree not to engage in any of the following conduct in connection with the App:
Violation of these prohibitions may result in immediate termination of your license to use the App and may expose you to legal liability.
The App and all of its content — including but not limited to the game design, puzzle levels, visual artwork, character designs and animations, mood themes, sound effects, music, text, logos, graphics, and the "Mood Bubs" name and branding — are the exclusive intellectual property of Ampersant and are protected by copyright, trademark, trade secret, and other applicable intellectual property laws.
All rights not expressly granted to you under these Terms are reserved by Ampersant. Nothing in these Terms shall be construed as granting you any ownership rights or other interest in Ampersant's intellectual property.
If you provide feedback, suggestions, or ideas about the App, you grant Ampersant a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, and incorporate such feedback into the App or its successor products without compensation to you.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMPERSANT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMPERSANT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GAME PROGRESS, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF AMPERSANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS WHERE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, AMPERSANT'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
IN ANY EVENT, AMPERSANT'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO AMPERSANT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $10.00.
You agree to defend, indemnify, and hold harmless Ampersant and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit or transmit in connection with the App.
Ampersant reserves the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your license to use the App shall immediately cease and you must uninstall the App from your devices.
You may terminate these Terms at any time by uninstalling the App. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 4 (Virtual Currency and In-Game Items), 6 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Indemnification), 12 (Governing Law and Dispute Resolution), and 13 (Severability).
Ampersant reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where feasible, provide notice within the App. Your continued use of the App after such changes are posted constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the App and uninstall it from your devices.
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in [Jurisdiction].
Notwithstanding the foregoing, nothing in these Terms shall prevent Ampersant from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ampersant with respect to the App and supersede all prior agreements, representations, or understandings relating to the same subject matter.
